Pepper Spray, the Law and Lawyers
Pepper spray, if employed at the right
time, can provide police officers with protection from both an armed suspect and
a lawsuit. A growing debate in U.S. courtrooms is when pepper spray may be used
by officers. In Passino vs. State of New York, a man who was ultimately
convicted of DUI accused a state trooper of using excessive force. The trooper,
after repeated requests for the suspect to remove his hands from his pockets,
sprayed a single, one-second burst of OC--bringing immediate compliance.
The court ruled that the trooper's use of OC on an irrational, non-compliant was
justifiable. The suspect was warned of the impending spray, and needed to be
handcuffed. Dangerous situations involving control holds and the wrestling of a
suspect can be avoided using pepper spray. The proper employment of the spray
can help officers in avoiding unnecessary risks.
On the suject of irrational behavior, pepper spray or stun guns can be helpful in domestic situations as well, should it become
necessary. It is always better to contact law enforcement should a situation get
out of hand. Should divorce become necessary, every state can provide
competent legal council. For example, for a NJ Divorce
or NJ family law situation, you need
to contact someone who is qualified to handle these sorts of cases in that
state.
